{"id":54,"date":"2016-08-29T14:04:30","date_gmt":"2016-08-29T12:04:30","guid":{"rendered":"http:\/\/datawiz.zpid.de\/?page_id=54"},"modified":"2019-02-23T12:16:09","modified_gmt":"2019-02-23T11:16:09","slug":"legal-status-of-research-data","status":"publish","type":"page","link":"https:\/\/datawizkb.leibniz-psychology.org\/index.php\/before-my-project-starts\/copyright\/legal-status-of-research-data\/","title":{"rendered":"Legal Status of Research Data"},"content":{"rendered":"<p style=\"text-align: justify;\">Unfortunately, the legal status of research data has not yet been fully resolved and varies from country to country. <a href=\"http:\/\/www.knowledge-exchange.info\/\" target=\"_blank\" rel=\"noopener\">Knowledge Exchange,<\/a> a collaboration between the finnish <a href=\"https:\/\/www.csc.fi\/\" target=\"_blank\" rel=\"noopener\">CSC &#8211; IT Center for Science<\/a>, <a href=\"http:\/\/www.deff.dk\/english\/\" target=\"_blank\" rel=\"noopener\">Denmark&#8217;s electronic research library<\/a> (Deff),\u00a0 the <a href=\"http:\/\/www.dfg.de\/\" target=\"_blank\" rel=\"noopener\">German Research Foundation<\/a> (DFG), the British <a href=\"https:\/\/www.jisc.ac.uk\/\" target=\"_blank\" rel=\"noopener\">Joint Information Systems Commitee<\/a> (Jisc) and the Dutch <a href=\"https:\/\/www.surf.nl\/en\" target=\"_blank\" rel=\"noopener\">SURFfoundation<\/a>, published a <a href=\"https:\/\/repository.jisc.ac.uk\/6280\/\" target=\"_blank\" rel=\"noopener\">Report on the legal status of research data<\/a> in the four Knowledge Exchange partner countries. Additionally, the German <a href=\"http:\/\/www.nestor.sub.uni-goettingen.de\/education\/index.php\" target=\"_blank\" rel=\"noopener\">nestor<\/a> (Network of Expertise in Long-Term Storage of Digital Resources) group published a <a href=\"https:\/\/nestor.sub.uni-goettingen.de\/handbuch\/\" target=\"_blank\" rel=\"noopener\">manual<\/a> which includes a chapter on the German legislation concerning copyright.<\/p>\n<p style=\"text-align: justify;\">Based on these resources the legal situation of research data is as follows (according to German law):<\/p>\n<ul style=\"text-align: justify;\">\n<li>There is no copyright on bare facts; therefore, research data are not likely to fall under copyright because they will usually not suffice the two criteria for copyright protection which are defined in the German <em>Urherberrechtsgesetz (Urhg)<\/em>: originality and individuality (\u00a7 2 Urhg).<\/li>\n<li>Nonetheless, it is possible that copyright requirements for databases are fulfilled by sui generis database rights (\u00a7 4, \u00a7 87a, \u00a7 87b Urhg) if a substantial investment took place. Please note that scientific and legal meanings of the term database differ.<\/li>\n<\/ul>\n<p>If copyright applies, the <a href=\"https:\/\/datawizkb.leibniz-psychology.org\/index.php\/before-my-project-starts\/copyright\/data-ownership\/\">ownership of data<\/a> has to be clarified.
